New Terms Effective 1 September 2025

From 1 September 2025, updated Terms & Conditions apply to all BalloonMan flights and ticket purchases. These changes clarify our policies around weather-related cancellations, rescheduling, and refund requests. All customers booking flights on or after this date are bound by the new Terms & Conditions.

Important

Please ensure that all members of your party have been made aware of the following terms and conditions.


Terms and conditions apply to all flights booked and/or vouchers purchased from Balloon Flights Over Melbourne trading as BalloonMan, its agents or representatives. Your acceptance of these conditions is a term of supply of the Services.


By booking, re-scheduling a flight, or purchasing a voucher, you are accepting supply of the Service, and you are agreeing to be bound by these conditions. If you do not accept these conditions you should contact Balloon Flights Over Melbourne trading as BalloonMan immediately and prior to accepting supply of the Service.


* To secure your booking, full payment is required within 48 hours of booking your flight with Balloon Flights Over Melbourne trading as BalloonMan or by the date specified in your Booking Confirmation Email. Unless prior arrangements have been made and agreed to by both parties. If payment has not been received by the specified date and time, Balloon Flights Over Melbourne trading as BalloonMan gives no guarantee that your booking is secure.


All payments made by Credit Card are subject to Authorisation by their respective bank.


Those booking within a 48 hour period prior to flight date; will be required to supply credit card details as payment or as Security.

Definition

Service refers specifically to the hot air ballooning mentioned on this documentation and generally to the range of products offered by Balloon Flights Over Melbourne trading as BalloonMan, including customised activities arranged by agreement. Service Operator refers to Balloon Flights Over Melbourne trading as BalloonMan or any independent contractor supplying/delivering the services to you under the terms of your Agreement with Balloon Flights Over Melbourne trading as BalloonMan.

Liability

Under no circumstances will Balloon Flights Over Melbourne trading as BalloonMan be liable for direct, indirect, consequential or incidental damages including but not limited to: lost or damaged property, lost profits or savings or damages for disappointment.


Balloon Flights Over Melbourne trading as BalloonMan may arrange for the hot air ballooning to be performed under a ‘code sharing’ arrangement, i.e. it may subcontract another ballooning company to provide you with your flight. In such instances, Balloon Flights Over Melbourne trading as BalloonMan accepts no liability in connection with such services or for any loss, injury, or damage to or in respect of any person or property. Balloon Flights Over Melbourne trading as BalloonMan reserves the right to alter contents of products and location when deemed necessary. Balloon Flights Over Melbourne trading as BalloonMan does however warrant providing services of equal value.


In agreeing to our terms and conditions, you agree to comply with all current State Government Restrictions, including vaccination requirements and wearing a mask when required.


Please note upon booking that all ticket costs have an additional and non-refundable ticketing fee of at least $25.00 per person charged by the ticketing reservation platform.


All tickets are subject to our $25.00pp refund administration fee where applicable.

1. Cancellation, Rescheduling & Administration Fees


Administration Fee

  • All ticket costs include a non-refundable administration fee of at least $25.00 per person.
  • This fee may be varied at our discretion and applies to all bookings.


Changes to Bookings

  • Rescheduling: Changes are permitted in line with our policy and within the required notice periods (see below).
  • Passenger Numbers:
  • Increasing: Allowed if capacity and weight limits permit.
  • Decreasing: Reductions within 7 business days of your flight may incur cancellation fees.
  • Transfers: You may transfer your ticket to another passenger of similar weight at no cost. If the replacement differs significantly in weight, you must notify us at least 3 full business days prior.
  • Cancellations: If you choose to cancel and Balloon Flights Over Melbourne trading as BalloonMan cannot accommodate your changes, cancellation fees apply.


Rescheduling Your Booking

  • No Fee: Passengers may reschedule their booking at no charge if notice is given outside the cancellation fee period (see below).
  • Within the Cancellation Period: Rescheduling inside the relevant cancellation period is treated as a cancellation, and cancellation fees apply.
  • Availability: Rescheduled dates are subject to passenger space and weight limits.
  • Validity: Tickets remain valid for 12 months from purchase unless otherwise specified.


Notice Periods

  • Business days exclude weekends and public holidays.
  • Example: For a Saturday or Sunday flight, notice must be given before 5:00 p.m. on the Tuesday prior.


Cancellation Fees – 1 to 3 Passengers

  • 4–5 full business days prior: $50.00 per person.
  • Within 3 full business days: 100% cancellation fee.
  • Failure to attend: Entire fare forfeited. Lateness is treated as non-attendance.


Cancellation Fees – 4 to 10 Passengers

  • 6–7 full business days prior: $50.00 per person. (Gift vouchers will be invalidated.)
  • Within 5 full business days: 100% cancellation fee.
  • Failure to attend (any group member): Entire fare forfeited for that passenger. Lateness is treated as non-attendance.


Important Conditions

  • No Shows: Tickets will not be refunded or rescheduled under any circumstances.
  • Replacement Passengers: It is your responsibility to find replacements if you cannot attend. We may attempt to assist, but cannot guarantee success.
  • Insurance: Passengers are advised to obtain their own insurance for unforeseen circumstances (including illness).
  • Weather & Safety Cancellations: If BalloonMan cancels a flight due to weather or other safety reasons, there is no penalty. Passengers will be offered rescheduling or a refund in line with ticket validity and refund request timelines.


2. Agent Bookings

Bookings made via an agent or 3rd party may be subject to terms and conditions separate to those of Balloon Flights Over Melbourne trading as BalloonMan. You are advised to determine if these conditions are acceptable before arranging a booking via an agent.

3. Gift Vouchers, Gift Cards & Discounted Tickets

Validity

  • Gift Vouchers purchased on or after 1 November 2019 are valid for 3 years from the date of purchase (as required by Australian Consumer Law).
  • Gift Vouchers purchased before 1 November 2019, and all Discounted Tickets, are valid for 12 months from the date of purchase.
  • All expiry dates are printed on the voucher or ticket. Expiry dates are fixed and will not be extended.


Redemption into a Flight Ticket

  • Once a Gift Voucher or Gift Card is redeemed to make a booking, it becomes a Flight Ticket.
  • From that moment, the expiry is the earlier of:
  • 12 months from the redemption date, or
  • The original voucher expiry date.
  • Example: If you redeem a 3-year voucher with 18 months left, the ticket lasts 12 months. If you redeem a 3-year voucher with 6 months left, the ticket expires in 6 months.


Conditions

  • Gift Vouchers, Gift Cards and Discounted Tickets are:
  • Transferable (conditions may apply).
  • Non-refundable in part or full.
  • Not exchangeable for cash.
  • They are valid only once fully paid for. Dispatch occurs only after payment, unless otherwise agreed.
  • It is the responsibility of the purchaser or recipient to use the voucher or ticket within its valid period.
  • Expired vouchers, tickets or discounted offers cannot be used, rebooked, refunded or exchanged for cash.


Discounted Tickets (Special Conditions)

  • Discounted Tickets are sold on a non-refundable basis.
  • If a flight is cancelled due to weather or safety reasons, the ticket will remain valid for rebooking within the original validity period.
  • Under the Australian Consumer Law, a refund is not required where the service can still be supplied by rescheduling.
  • Refunds are only available if BalloonMan cannot provide the service at all within the validity period.


Cancellations & Expiry

  • If BalloonMan cancels a flight due to weather or safety reasons, your ticket or voucher remains valid for the balance of its original validity.
  • Expiry dates are fixed and will not be extended under any circumstances.


Additional Terms

  • An administration fee may apply to cover booking, confirmation and refund processing.
  • Discounted offers cannot be combined with other promotions.
  • Repeat Passenger Offer: Fly with us a second time at 50% off if booked within 12 months of your first flight. Each discounted passenger must be accompanied by a full-fare paying passenger on the same flight package.


Legal Disclaimer

This policy complies with the Competition and Consumer Amendment (Gift Cards) Act 2018 and the Australian Consumer Law.

  • All BalloonMan vouchers are sold as discounted vouchers.
  • The minimum 3-year voucher validity is preserved, in line with Australian law, for all full priced vouchers sold prior to 15th August 2025..
  • Once a voucher is redeemed into a booking, it becomes a Flight Ticket. The ticket validity is the earlier of 12 months from redemption or the original voucher expiry date.
  • Discounted vouchers are non-refundable. Where the service can still be supplied by rescheduling within the validity period, BalloonMan is not legally required to provide a refund.

4. Weather Cancellations, Refunds & Extensions

Weather & Safety Cancellations

  • Ballooning is weather-dependent. If your flight is cancelled due to unsuitable weather or another unforeseen safety reason:
  • You may rebook your flight on another date at no cost, or
  • If eligible, you may request a refund (see conditions below).

Refund Eligibility

  • Only full-fare tickets that meet refund terms are eligible for a refund.
  • A $25 per person administration fee applies to all refunds.
  • Original booking fees (1.9% credit card + 1.9% ticketing platform fee) are non-refundable.
  • Refunds are only available if requested within the first 6 months of ticket validity.
  • Tickets remain valid for 12 months from purchase.
  • Gift Vouchers and Discounted Tickets (including seasonal specials) are strictly non-refundable.


Expired Tickets & Vouchers

If your ticket or voucher has expired, you may choose one of the following options:


Option 1 – Standby Flight

  • Join a flight on a standby basis where spare seats are available, usually at short notice (often less than 24 hours).
  • Only one standby opportunity will be offered.
  • If declined, the ticket is void.
  • Standby passengers may be displaced by full-fare paying passengers.


Option 2 – Premium Package Re-Purchase

  • Purchase a new Premium Package equal to the number of expired tickets/passengers.
  • We will extend the expired voucher(s) by 3 months fee-free.


Option 3 – Paid Extension

  • Pay to extend your expired voucher/ticket (must be done within 12 months of original expiry).
  • 1-Month Extension: $250.00 per person
  • 3-Month Extension: $350.00 per person
  • 6-Month Extension: $400.00 per person
  • Extension is valid only from the date of expiry, for the chosen period.


Fee-Free Extensions (Special Circumstances)

  • If you have made 3 or more genuine booking attempts during your voucher validity and your flights were cancelled by BalloonMan due to weather or insufficient passenger numbers, extension fees will not apply.
  • In these cases:
  • Expired 12-month tickets will be extended 3 months free of charge from the original expiry date.
  • Further fee-free extensions may be granted if 3 genuine attempts are made during the free extension period.


Definition of a Genuine Attempt

  • A genuine attempt means:
  • You made a confirmed booking, and
  • The flight was cancelled by BalloonMan (not by you).
  • While we may offer alternative dates after a cancellation, it is the ticket holder’s responsibility to rebook within the validity period.


Weekday-Only Restrictions

  • BalloonMan reserves the right to restrict the use of expired, extended, or disputed tickets to weekday flights only (Monday–Friday).
  • This is due to extremely high demand, limited weekend capacity, and frequent weekend weather cancellations.

5. Safety, Staffing & Mechanical Conditions

Weather Dependency

  • Hot air ballooning is highly weather dependent. Factors such as wind direction, wind speed, lack of wind, rain, low cloud, fog, or other adverse conditions may require us to cancel or postpone a flight.

Passenger Safety First

  • Passenger safety and comfort are our highest priorities. If the Chief Pilot considers conditions unsafe or unsuitable, the flight will be cancelled or rescheduled.

Minimum Passenger Numbers

  • Flights may be postponed if minimum passenger numbers are not met.

Flight Path & Launch Sites

  • Wind direction always determines our flight path. Launch sites are chosen on the morning of the flight to ensure the safest and most scenic experience possible. Flight direction and landing locations cannot be guaranteed.

Operational Factors

  • In rare cases, flights may also be cancelled or rescheduled due to mechanical issues, staff availability, or passenger numbers.


6. If Your Flight is Cancelled - Re-scheduling your flight

  • If your flight is cancelled, please contact our office as soon as possible to rebook on another date.
  • If you choose not to rebook, or are unable to rebook, you may request a refund if your ticket type is eligible.
  • Gift Vouchers and Discounted Tickets (including seasonal specials) are strictly non-refundable. These can only be rescheduled within their validity period.
  • If you purchased through a booking agent, you must contact the agent directly regarding refunds, as their policies may apply.
  • Gift Vouchers and Discounted Tickets (including seasonal specials) are strictly non-refundable.
  • They may only be rescheduled within their original validity period and are subject to day-of-week restrictions set out in our booking policy (e.g. some discounted offers may be limited to weekday flights, Monday–Friday).
  • Once the validity period expires, unused vouchers or tickets are void and cannot be rebooked or refunded, unless revalidated through our extension fee policy.


7. Pre-Flight Confirmation & Passenger Responsibility

Please call our office on 1800 HOT AIR (1800 468 247) or +61 3 9427 0088 at the advised time on the day before your flight to re-confirm all details, including the mobile number we will use for any cancellation texts.

  • We strongly recommend providing a backup contact number for the morning of your flight.
  • It is your responsibility to ensure that all contact numbers provided are current and in working order.
  • Flight Times
  • The flight time shown on your original booking confirmation is an estimate only.
  • Exact meeting times are confirmed the day before your flight.
  • Times vary due to the time of sunrise, weather conditions, and air traffic control requirements.
  • You and your party must arrive at the designated departure point before the confirmed departure time. Please ensure all passengers and any breakfast guests are aware of these requirements.
  • If you have not received your flight information, you must contact Balloon Flights Over Melbourne trading as BalloonMan at least 24 hours before your scheduled flight.


⚠️ Important: Late arrivals cannot be accommodated. Flights depart strictly at the confirmed time. Failure to arrive on time will result in forfeiture of your ticket with no refund or reschedule available.

8. Pilot, Crew & Safety Instructions

  • For your safety, you must always follow the directions of the pilot and ground crew, comply with any local codes of conduct, and act sensibly and responsibly at all times.
  • Completion of BalloonMan’s digital waiver is a mandatory prerequisite to flying. Passengers who have not signed the waiver will not be permitted to board, and tickets will be forfeited without refund.
  • You agree to indemnify Balloon Flights Over Melbourne trading as BalloonMan, including its owners, officers, and employees, against any loss or damage caused by your actions or the actions of any member of your party.


Drugs, Alcohol & Impairment

  • Passengers must not be under the influence of drugs or alcohol at any time during the flight experience.
  • You must not take any medication that could impair judgment, coordination, or your ability to follow instructions.
  • Passengers suspected of being under the influence will be refused boarding, and their tickets will be forfeited with no refund or reschedule available.

Right to Refuse Boarding

  • BalloonMan pilots and crew reserve the right to deny boarding to any passenger who is:
  • Aggressive, abusive, or disruptive;
  • Acting in a way that endangers the safety, comfort, or wellbeing of others; or
  • Otherwise deemed unfit to fly.
  • In these cases, tickets will be forfeited without refund or reschedule.


🚫 Zero Tolerance Policy

BalloonMan has a strict zero-tolerance policy for:

  • Aggression, abuse, intoxication, unsafe behaviour, or threatening conduct.
  • Refusing to comply with safety instructions, including smoking near the balloon or equipment, which is a breach of Civil Aviation Safety Regulations (CASR) Part 103 and CASA safety standards.
  • This applies not only on the day of your flight but also across all communication with our staff, including email, phone, in person, or through communications that are aggressive, abusive, or threatening in nature, including legal intimidation.


Passengers who breach this policy may be:

  • Refused service or denied boarding, with tickets forfeited without refund or reschedule; and/or
  • Refused future bookings with BalloonMan at our discretion.


9. Medical Conditions & Health Responsibility

  • Hot air ballooning is a physical activity that may not be suitable for all individuals. If you have a pre-existing medical condition (such as heart problems, back or joint conditions, mobility issues, or pregnancy), you should seek advice from your medical practitioner before booking or flying.
  • By booking with Balloon Flights Over Melbourne trading as BalloonMan, you acknowledge that you are fit and able to participate in the flight experience.
  • Passengers are responsible for managing their own health and must not fly if advised against it by a medical professional.
  • BalloonMan will take all reasonable steps to provide a safe flight in accordance with Civil Aviation Safety Regulations (CASR) Part 131. However, BalloonMan is not responsible for health complications that arise from a passenger’s pre-existing medical condition or failure to seek medical advice before flying.
  • By participating, you agree that BalloonMan, its owners, officers, and employees will not be held liable for any loss, injury, or complication related to your own medical condition, except where required by law.


10. Personal Belongings & Clothing

  • All personal belongings, including cameras, phones, and other valuables, are carried entirely at the owner’s risk.
  • Items left in BalloonMan vehicles are also the responsibility of the owner, and Balloon Flights Over Melbourne trading as BalloonMan accepts no liability for loss or damage.
  • BalloonMan is not responsible for any damage to clothing during the flight or related activities.
  • Passengers are advised not to wear light or white clothing, and high heels are not permitted for safety and comfort reasons.
  • We recommend wearing comfortable, weather-appropriate clothing and sturdy flat shoes to ensure a safe and enjoyable experience.



11. Boarding Restrictions

Children must be 6 years or older. Children must be able to see over the edge of the basket: 1.3m unaided by object or person. In most cases they must be accompanied by a paying adult. Passengers with disabilities are able to fly; though C.A.S.A does impose some restrictions:

  • All passengers are able to embark and disembark a balloon basket unassisted.
  • For their safety and that of their fellow passengers, they must be able to follow the pilot’s directions as required.
  • Flights last for approximately 1 hour and passengers must be able to stand for that period of time, and be able to adopt the landing position, as advised by the pilot-in-command, for landing. No wheelchair facilities are available.


* If you are aware you are pregnant, please check with your doctor, before flying. You are still subject to our cancellation conditions.

* Alcohol cannot be carried in basket.

* This is a stricly non-smoking experience, as enforced by Aviation Law.

12. Flying after Diving:

Passengers are not permitted to fly within 24 hours of completing a single no decompression dive, within 48 hours of a series of decompression dives or within 7 days of any dives requiring decompression or any technical (mixed gas) dives.
